And, technically, her mother is the only one who could be entitled to do anything with her daughter's body. After all, Howard wasn't Anna's husband.

In the end, though, can't they just READ HER WILL and see where SHE wanted to be buried?

I think Virgie is right to ask Bahamian government to take the child into child protective services. The judge could suggest that the parties agree that the body of ANS be released but that the parties also agree that ANS will be buried in the Bahamas. But I can see why the judge wants to know answers to the other questions like (1) who is the baby's daddy; and (2) what was the cause of death because those answers could really impact his decisions. For example if Stern is the father but is also a suspect if the cause of death is homocide, then clearly the body should go to TX and probably Daniel's body should go there as well. If Stern is not the father and there was no foul play, then the judge still might want to rule that the body goes to TX because he might be thinking that the baby might want to periodically visit her mother's gravesite and the grandmother could later make arrangements to have the grandson brought to TX also. Ii think whether the judge takes ANS's "wishes" into consideration will largely depend on what her cause of death was and whether she sufficiently stated a "wish" or had the capacity to state a "wish". The main thing is that the baby should currently be in the care of a conflict free caretaker.

I am a mother. I did not know Anna Nicole Smith. This is so clear cut. We know only one sure thing about the heart of Anna, she was a mother who loved her son and it's pretty obvious watching her interview with ET that his death broke her in half. There are a million reasons beyond the usual mother and child bond as to why Anna and Danial were so close. Niether really had any other close relatives. His father was non-existant in his life, and her family was estranged for decades. They were consistantly and unconditionally the only ones each could count on. If Vergie wants to prove to the world that the bone of a mother is left in her, then do what is obviously right. Bury your daughter with her child. The place matters little, it is the act that is so important. As a mother with the right intentions, would you really keep fighting over your daughter's final resting place as she lay in a morgue rotting. Even strangers see this as totally dispicable. You still can not put unconditional love of your child first, and those of us who are true mothers can see this for what it is, because the heart of a true mother would be thinking of far more important things. Maybe you should try to love your daughter the way your daughter loved her son. Anna could have taught you alot about the act of loving a child Vergie. Even if her own life was influenced by drugs, It's never hard to see love when it is present, in your case I guess Anna was right, because your every move just speaks volumes about how you really feel about your daughter Anna. I want to believe that you love your child, but you make that very difficult by your actions. The Bahamas are not important, the drugs are no longer important, the hollywood lifestyle is no longer important, It now boils down to allowing a mother and her child both dead, to rest together in peace, this decision would be an easy one for any real mom.

The Judge is a piece of crap. He was paid off to and took his time to get his 5 days of fame. If you listened to the case on TV the judge already made up his mind before the case even started by comments he made to Vergie and the way he talked to her lawyer (calling him TEXAS). What a jerk. I hope for the love of God that this case be taken a little more seriously than it has been. So far they have turned it into a damn joke. Anna’s son, daughter, Mom and others need to be treated with respect and the rule of the real laws need to be enforced. I saw what happened in court yesterday, that slimebag lawyer of Howard K. Stern walked up and snuck the cup that Larry Berkhead was drinking out of. Now they will get Larry’s D&A so Howard will no for sure whether Larry is the real dad as he already knows he is not. You know damn well he has had a swab of himself and Danielynn done in the Bahamas. He knows he is not the dad, that’s why he is fighting so damn hard. He needs to be in jail. He is responsible for the death of Anna and Daniel. Whether he did it directly or not someone either him or Anna gave Daniel Methodone in that hospital room ! Howard was an enabler and sttod by and watched Anna take drugs and even got them for her. So anyway you look at it he is an unfit person. He needs to be investigated to the fullest extent on the law. Bahamma laws are just as crooked as ARUBA’S ! You can literally get aways with Murder in these drug infested Islands.
I hope somehow that bady will be protected. Howard is holding the baby hostage. If all else fails and the BAHAMMA courts will not do the right thing and allow real justice to prevail then I hope someone kidnaps that baby and brings it to the USA where she belongs ! Enough of BS already.

Anna’s mother should bury her daughter in Texas or California and Daniel needs to be brought back to the states and buried beside her. Anna was born and raised in the USA and so was Daniel. To bury Daniel in a foreign land and Anna too, is a disgrace.

I think Vergie loved her daughter and there is a saying when your child get into drugs you have to love them enough to let them hate you, and sometimes it takes years for that to happen that does not mean that Vergie did not love Anna it simple means that she would not stand by and support her Drug habits and until you have had to expierence this kind of problem there is no way you can understand if it were a alcholic you would know that you don't just give them what they want either.
